Here’s the rub – a Manhattan jury yesterday found that a psychologist accused of groping a prospective employee touched her, but it wasn’t a bad touch. Dr. William Swan was found not guilty in the assault-and-battery lawsuit by a six person jury on the July 18.
The jury foreman, Post City Hall Bureau Chief David Seifman, said the jurors considered it a case of “he said/she said” – and neither told the whole truth. “The testimony on both sides was not entirely believable,” Seifman said, and “there was no evidence against him besides what [Sola] said.” He said that while the jurors believed Swan did massage her…
Ana Sola had claimed the doctor told her that “her job duties would include sexually gratifying male and female patients”. “He even told me there might be oral sex involved,” Ana Sola recalled of her “very strange” job interview with Dr. William Swan in 2002. She said he told her it wasn’t a big deal.
“I want to assure you there won’t be any penetration,” she quoted Swan as saying.
UPDATE: Ana Sola is not exactly the world’s most stable person. Apparently she’s a “being of light coming into this Earth to walk as a Healer to facilitate healing to those in need of guidance, support, answers and unconditional love.” This is according to her her personal profile on wisewomensacredwomen.net
She also said he told her she would need to apply some of his special “therapeutic massage” techniques on him.
The Spanish beauty is suing Swan in Manhattan Supreme Court for assault and battery, charging he groped her while demonstrating his innovative massage technique on her.
Swan denies touching her at all, and said she was the one who suggested giving clients “squigglies” – her euphemism for a very intimate form of touching.
Sola, a former model and birthing coach who now works as a waitress in Miami, told jurors Swan was interviewing her for a position as a co-trainer for his “Assertiveness Training: the Relaxation Method” program.
She was told the program was aimed at helping patients “increase assertiveness following traumatic or fearful events.”
It was during her second interview at Swan’s East Side office that he told her he wanted to demonstrate his massage technique on her, and to go into his bathroom and change into a bathrobe, she testified.
She said Swan had her lie down on some towels on the floor, and started rubbing her shoulders, asking her to rate her comfort level for what he was doing on a scale of minus three to plus three.
He slid the robe down her shoulders, and when he noticed she still had a bra on, he tried to take it off, Sola said. She said she told him to stop – and he told her it was all a part of his “therapy.”
After calming her down with “professional” jargon, Swan moved down to rub her feet, and then slid his hand up under robe and up to her buttocks.
“I said, ‘Stop! What are you doing?’ He said, ‘You left your panties on as well?’ I said, ‘Of course,’” Sola said.
“At this moment I started to feel this massage was very strange,” she said.
He asked her her comfort level and she said, “Minus 24.”
It was then that he told her that her duties would include satisfying aroused patients, Sola testified.
She said when she left, Swan handed her an envelope that she later discovered contained $100 as payment for her “training” session.
Sola’s lawyer, Gary Certain, played a tape recording of a phone conversation Sola had with Swan the next day, when he called her to see how she was doing.
On the tape, she asked why he touched her, and after lots of stumbling, the management consultant told her “we attempted to work something out” and “I paid you the fee.”
In a later conversation – after he’d spoken to his lawyer – he said he didn’t know what she was talking about.

JUSTICE FOR MINORITY WOMEN DOES NOT EXIST.
Dear Mr. Reporter
For almost two weeks, I had to see how the newspapers and the media had defamed and said all kind of lies and terrible things about me. For almost two weeks, I had to witness this without been able to speak out or defend myself. For almost two weeks, me or my attorneys could not make any comment or say anything to the press, because of a restriction orders we had against talking to the press during the trial was on. For almost two weeks I cried trying to understand, why all of you reporters and people all over the internet will manufacture a story based on lies. Lies that are easy to sell to the public because of their sensationalist content. Why will you take a phrase from here, a test from there and a few words “someone else” say without knowing what are they talking about; just to create a “story” that totally differ from the truth.
I don’t know how reporters can sleep at night. I understand sensationalism stories sell very good. But, some times these very distortional stories can destroy some one’s life. How can you take a few words from here, some comments from there and a few words some one else said and twisted in a way that can destroy a person’s credibility and persona?
Why you only wrote about he crazy things they said against me during the trial? Why you didn’t write anything about the false evidences they produced during the trial? Why you didn’t write that this “expert witness” the one who was hired to destroy my persona and credibility was none other than an Old friend and colleague or Dr. Swan’s? Why you didn’t write about all of the lies and non sense testimony they gave? With your story and the things you wrote, you didn’t even gave me never the benefit of the doubt. Now you move on to the next story and couldn’t care less.
Even if Dr. Swan did something to me on your mind, he is a distinguished man with an important career. They could not destroy his name, his career. But, they can destroy me and my persona, because who Am I, to them right? An extraterrestrial that is a messenger of God, right? An immigrant single mother with no name or career to them, right? why even consider the fact that I may be telling the truth and behind “that distinguished man with a successful career” is an unprofessional liar and a pervert!.
Everything that I said he did to me is TRUE. I had no reason to create something like that, why would I do that? I had a happy life and career in the childbirth field and was doing what I love, helping women. it enrages me that is a ‘he said – she said” kind of situation, but it turned against me. But let me ask you something.

WHY DID HE LIED DURING THE ENTIRE TRIAL? WHY HIS ATTORNEY AND HIM PRODUCE FALSE EVIDENCES? WHY DID THEY HIRED TO TESTIFIED AGAINST ME “AN OLD FRIEND/COLLEAGUE” OF DR.SWAN? IF HE DIDN’T HAVE NOTHING TO HIDE….. WHY HIS ATTORNEY, WITNESS EXPERT AND DR.SWAN LIED AND CREATED SUCH A FANTASTIC STORY ABOUT ME, JUST SO NO ONE WILL BELIEVE ME AND TO HIDE THE TRUTH OF WHAT HAPPENED.
I can be hurt, I can be in pain, I must lift myself from the ground and keep fighting because I won’t stop until the truth about this story comes out. Until I have at least the chance to tell my story, my side of the story, the truth and nothing but the truth.

Do the responsible thing and publish the “real” outcome of the case.
Dr. Swan was found GUILTY of the very first account, they choose not to press charges and let him walk out as nothing had happened, but he was found GUILTY of the first charges against him. If you are going to write, please write the truth. Look at the facts, instead of listening to Dr. Swan’s friends.
