Court bans ‘disabled crusader’ from suing after filing 400 lawsuits

Jarek Molski a wheelchair bound self-described crusader for the disabled cannot file another lawsuit.
He has filed more than 400 lawsuits under the Americans with Disabilities Act and a federal judge ruled that he was barred from any further litigation.
The US Supreme Court upheld the unusual ban by refusing to review the judge’s decsion.
Molski has sued restaurants, retail outlets, bowling alleys, and even wineries in his marathon spree of litigations.
In less than two years Jarek had filed more than 400 suits and had earned hundreds of thousands of dollars in settlements.
Molski, 38 who was injured in a motorcycle accident demanded that owners be fined $4,000 for every day their business failed to meet federal standards.
Many businesses settled out of court rather than trying to fight the exacting standards of the ADA act and the high legal costs involved.
Critics claim he was merely an extortionist who went hunting for businesses and used the ADA rules for personal gain.
The Hitching Post in Casmalia owner claimed Molski whohas a law degree, but has never practiced as an attorney filed over 500 lawsuits filed against businesses in California.
The owner said “He targeted mostly small, family owned establishments like the Hitching Post. Most are for frivolous violations of the Americans with Disabilities Act(ADA), such as the toilet being one half inch closer to the wall than it’s supposed to be, a doorway one inch too small or a counter a few inches too high.”
According to the restaurant’s website they spent $60,765.97 successfully defending a federal case against Molski only to have him file another suit in local courts.
In 2004 US Federal Judge Edward Rafeedie ruled he was a “hit-and-run plaintiff” and ruled he was barred from suing under the ADA statutes again.
